I was in an car accident. I was in the right hand side of the parking lot and I was backing out of my parking space. I was in the middle of the parking lot, and a guy pulling out of his parking space on the left hand side of the parking lot. While I was in the middle of the parking lot, the guy back his car into mine (In a hurry). After this accident happened, this guy admitted that he hit me and the accident was his fault. The police showed up and we told our stories and he admit to the police that the accident was his fault and it was on the police report. After the accident, we went our separate ways. I talked to my insurance company and they told me that since the guy that hit me admitted that he caused the accident, I had to take it up with the guy's insurance company. I called the insurance adjuster from the other insurance company and gave my statement and he told me that he viewed the accident as both our faults and would not pay me to have my car fixed. And I told him that his client admitted to the accident and he said it didn't matter. I would have to go to my insurance company to have my car fixed. I have arbitration. Also, the adjuster said that I can go through arbitration. I don't know what to do. What can I do about it?

I have a little 2001 Saturn SL2 and I'm on my oldest sisters policy and it runs around $350 a month for both of us (I'm only 18 and she has like a 5 or 6 speeding tickets). My saturn is nothing but a big dent in my walllet so I've found a 2004 Hyundai Santa Fe that I want to get but my main concern is how much would my insurance go up? Would it be a drastic change since the my car is 2001 and the SUV I want is a 2004? SUV are more expensive when it comes to insurance and with it being a 2004 I'm a little worried. Okay, so here is the story. i was in a private McDonald's car park when the was car meet event, nothing official boy racers if your wish, the car parks were full to the brim with cars parked all over the place, with hardly any lighting at 10 o clock as night, visibility wasn't at its best. i was stuck in a Que of traffic trying to get out of the car park, when the car in front started reversing for what ever reason, so i put my car into reverse, had a glance in the rear view mirror which really was no help because of the poor lighting. I let my foot of the brake as the car in front stated reversing an with in milliseconds i herd people shouting, so i stopped and got out, there was a car right behind me must have on been cm away, with a massive dent in the drivers door. although i didn't even feel a thing i quickly apologised and began to sort the problem. i have no clue whether the driver had his lights on or not. i suspected that i couldn't have done it because i had barely moved and there was no damage to my car what so ever. Although this being my first accident i was nerves so took responsibility. We both decided to sort it out between our selves, i didn't want my insurance to go up as it is high enough already as a young driver, he said he would need a new door and i agreed due to the size of the dent, so he found one on eBay for 150 and would take nothing but that as i only had 100 in the bank at the time we drove to the cash machine he took the 100 and we agreed that i would pay him the other 50 in two weeks when i got paid, i writ a receipt to say that i had paid him this money and there was a following 50 to come, with his signature and address phone number ext... two weeks later herd nothing although i kept the money aside for a couple more weeks just in case, but still herd nothing after over a month he texts me asking for the 50 which i no longer have, i explain to him that he has left if for over month and now expects it instantly. Now he says he is going to put in an insurance claim, which i cant no see happening due to 2 reasons 1. he has already tried to sort it him self and failed to because of a fault of his own 2. because he was on a private car park at an illegal car meet Am i right? or is there anything i should do or know about this situation. well my mom got in at fault accident she was the only one who was injured the guy who she knocked into was ok no sign of no injury, the guy is suing my moms insurance company (Geico) for possibly more then 10,000 in bodily injury which my mom only has 10,000/ 20,000 in bodily injury, let me say this again the guy is not injured AT ALL!!! The police that wrote up the report at scene will be super great witnesses to the scene the guy was ok, while my poor old mother had get stretched into a ambulance lucky her pip coverage covered her medical bills. On Christmas Day I went out in the car to pick up some drinks from the petrol station and on the way out of the station I bumped someones car. I stopped and got out to give them my details (name, address and phone number) and then went home. In the panic of the moment I think I just wanted to get home as it was Christmas Day and I didn't hang around to take photos, ask for witnesses or discuss options with the other driver, which in hindsight I regret and realise was stupid. When I got home, the guy called me up and, again with the stupid mistakes, I said that I would rather settle outside of insurance; the driver wasn't keen on the idea at first and wanted to settle through the insurance company but I couldn't call them until the next week as they were closed for Christmas. He texted me the next day saying that he was going to get a quote from a garage and got back to me later with a quote for 400 through a 'friend of a friend's garage'. At this point I was a bit suspicious and the amount seemed very high for what I thought was not a lot of damage but at the same time he said that he either wanted to do it like that or through the insurance and I really didn't want to loose my no-claims discount as insurance for young male drivers is very high without the no-claims. In the end I decided to pay him, not without a certain bitterness owing to the fact that he was pressuring me for an immediate decision, which also made me suspicious. Having sent the cheque for 400, he kept up communications initially and let me know that he'd received it. He said that he would send me a copy of the receipt from the garage for my records but once he received the cheque I never heard back and now cannot get a reply. Bit long-winded for a question but that's the background story, my question is two-fold: 1. Can I do anything about it? It's more the principle than the money that bothers me, I know that I caused damage to his car but I now suspect it wasn't as much as he claimed. 2. Does 400 sound like too much or should I stop worrying about it? I hit the back corner of his car with the back corner of mine, and he later told me that I had cracked the rear bumper, which needed replacing. I'm not sure of the make of the car but I think it may have been a Ford Fiesta or something similar. I would really appreciate any help as it's weighing on my mind... I don't like people walking over me. At least if the amount he claimed sounds reasonable I can put it down to him being a wanker but the amount claimed being fair and forget about the whole thing.
