At fault driver's car insurance won't pay for my damages!?

Hey guys and gals, My wife was in a car accident on 10/8 driving our truck with liability only insurance (IE: not full coverage because the truck is only worth ~$3000 and it's paid for). She was turning right and had slowed down to turn (with her turn signal on) when a speeding truck slammed into the van behind her, ramming the van in to our truck. The police filed a report, in which the driver of the speeding truck (an 18 year old kid, that had just left his house less than 1/4 mile away) was determined to be at fault. It is worth note that this happened in front of two different auto body shops, and within sight of the house the at fault driver had just left. Their insurance company, state farm, finally contacted us on 11/8 after not returning our phone calls for nearly two weeks saying they had determined he was in fact at fault and would send an adjuster the following Monday. He came, inspected the truck, determined it was repairable, then said we would hear from their office later that day. When they called they told us the damage was more than 75% of the vehicles worth so it was considered total and they would send the required paperwork to my email address to begin payment. Within 3 hours, the claim agent we had talked to the previous Friday said an owner of one of the auto shops had came forward (all of a sudden, no mention of a witness before) and that he had a notarized statement saying the van struck our vehicle before the truck struck the van. The insurance company now will not pay us for the damages. We tried to call the witness and get a copy of his report because State Farm would not give us the copy. Then we called the other auto body shop and both the owner and one of his employees both seen the accident and say that the truck was at fault, and the owner overheard the driver say specifically that it was his fault. When we bring this to the agents attention, she claims this is not evidence because they know the at fault driver. We found out that the first witness also knows the driver, but can't prove it. Ours is a small town, you don't have neighbors that you don't know or speak to. It seems we are at an impasse, and I have been without a truck for nearly 6 weeks. What should I do in this instance? Get an attorney? Our insurance agency is adamant about not intervening since we did not have full coverage insurance. It may be worth noting that my wife has had back and neck pain since the accident and went to the hospital the day of the accident, the family doctor twice since, and has an appointment with a chiropractor next week (all of which our insurance has paid for.)

I cancelled the policy and found a new provider. The insurance company then sent me a bill retroactively charging me for the original policy with the new information and premium changes. Can they retroactively charge me for the policy that I had already paid in full based on our original agreement? Does the insurance company have any legal recourse or right to collect this money? I already filed an official complaint with the NJ Dept. of Banking and Insurance and am waiting to hear back. Is This Right? (Retinal Detachment/Cataract/Lens/Insur... Question)?

Let me make a very long story short and get right to the questions. I have moved across the United States by myself at the age of 20 with no insurance covered by my parents, nor will they ever if they could. I had a retinal detachment in my left eye. Paid out of pocket for an eye doctor appointment, he freaked out and told me to go straight to the emergency room for emergency surgery since my entire retina was detached. After my surgery, half unconscious too, a social worker got assigned to me because I was under 21 and legally dependent on the state. So the state paid for my surgery. I had a 2nd one too because the first failed. During my 2nd surgery I had cataracts in my eye so they removed the natural lens. And they never replaced the natural lens since they feared the retina may detach again like the first time. But it stay together and I turned 21. So therefore, legally independent by the state. My check up appointment was after my birthday which the front desk of the eye section declared I must pay $80 for every check up visit, which they wanted me to come in every other week. And if I did not pay, I could not go in. Due to my 6 months of surgeries and recover time I had no money, and was not working. I live with my in-laws, and they were taking care of me, but they are certainly not going to pay my medical bills. So here I am now, age 22 and I have been working for about a year. My job does not offer health insurance until you worked for a year, and even then, there is a certain month you can sign up. I have been walking around for over a year without a natural lens, or ANY lens in my left eye. This is in no way like being blind. My doctor had told me that if I got my license and drove, if ever in an accident, I would get in serious trouble because you are not supposed to drive this way. Not that I do, I cannot see correctly so it is wicked dangerous. Having no lens in one eyes messes with your other eye. Hard to explain unless you have literally had this situation before. Sunlight glares into my bad eye, then into my good eye. Same with darkness or bright lights in general. I am actually very blind at night because of this. This is literally ruining my life. I have no money to pay for insurance, or the surgery which can be easily be 10,000 dollars. Is this legal for a county hospital to do? I have never heard of anyone in my situation. My payment was due November 20th and I sent the check on November 3rd. At the time, I made several checks, you know, paying bills and I didnt notice but I sent my insurance check to a Charity (I have a little boy that I sponsor and every month I send a $20 check) and the Charity check to the insurance company. Well, apparently my insurance company cashed the check and cancelled my insurance without letting me know. The only reason I know my insurance was cancelled is because the Charity returned my $300 check and thats when I realized my mistake. When I called my insurance, it was already cancelled 5 days prior and even though they cashed the $20 check, that wasnt even made out to them, they refused to reinstate my policy. I had to make a whole new policy and set up for them to take the money directly out of my checking account. My question is, is this fair? Did I just get screwed out of my money?

Hi, I recently bought my first motorbike a few month in advance of my 17th birthday, with the intention to ride it once im 17. When i got the bike, it had no MOT or road tax and it was registered as SORN (meaning it was registered as being off the road). So i filled in the registration document, rang up the DVLA and re-registered the vehicle as SORN again. I have one at fault accident on my record. It was a rear-end collision and it is a 2 pt. accident in California. I was shopping for new insurance. I made this statement about the at fault accident when filling out the forms for a quote online. At first GEICO the GEICO rates were looking way better than Progressive or other insurance companies so I thought I'd go with them. But when I went to go pay online, they did one last DMV record check, and came back with a higher rate. Even though I had stated the accident in the form previously. They waited to verify this at the very end and not earlier which I found annoying--they had my driver's licence earlier in the application process, so why wait till the very end! When filling out the Progressive quote forms, I also stated the info about my accident where asked. At the end, the form still considered me a Good Driver and the quote was much cheaper than Progressive. I went to pay and it did not recalculate my quote after a DMV check like GEICO did. I paid and am wondering if I am going to hear back from them saying I need to pay more. But I gave them all the info and I do now have a policy. So it appears that GEICO is tougher when it comes to having an accident, and Progressive doesn't let one at fault accident ruin a good driver discount? Does anyone have experience with this?

Hello, I would really appreciate any one who can help me out with this, personally i am so disgusted with the government and the way the country is run that i don't know much about politics as i stay away from it for my own stress levels. Two months ago my nephew took his own life, as well as a variety of mental health problems (Which of course also go's uncared for in this country) other reasons he couldn't cope to live in society was that he couldn't get a job (200+ job application attempts) he discovered that to increase his chance of getting a job he would learn to drive so he can get to A to B. After going into approx. 90% of his life savings he managed to take driving lessons and even managed to pass his test. At this point he couldn't get insured because he discovered even if he was in a FULL TIME job he couldn't afford it. Yes he was male and was an adolescent. But he didn't want to drive to show off , have a nice car . Etc. he wanted a car to get to A to B to increase the chances of getting a job. I want to know who is in charge of car insurance etc. (department of transport??) so i can write to them and explain the situation which makes me sick to my stomach thinking about. Everyones aware the government are trying to get young drivers off the road, but to then expect them to find a job even in this tough climate is beyond me. Why is it the LAW that we have car insurance?? I honestly think it's stupid. Shouldn't we, as free Americans, be able to make the choice of whether or not we want insurance, and still legally drive a vehicle, as long as we have a license, at our own risk? I live in New York. I'm 22. I was on my college insurance plan, but I lost it when I went on medical leave. I had an extension plan, but that also expired. I have no job because I'm too sick to work. If I would go back to college before I got a job. Right now, I'm on a strictly emergency health care policy with no preventive care that runs me about $188 a month. I need more coverage though. The problem is that I'm not eligible for most plans because I don't work. For the coverage I need, it will cost over $1,500 a month. I can't afford that, I don't have income. What do I do? *Before my college plan expired, I was going to doctors. I am diagnosed with POTS, and I was having sleep studies where I was being treated for day time sleepiness. Never got an official diagnosis, but I probably have Idiopathic Hypersomina. Both of these require occasional tests and I will need to see doctors regularly until I have a treatment plan. I'm also a cancer survivor and need to go back in to get a battery of tests every year or so. Out of pocket, just a an office visit cost around several hundred dollars. (I have no lapse in coverage.)

i did a quote online at progressive just to get an idea of how much the insurance would be for a 2005 yzf r6. i am 18 years old had my motorcycles license for 2 years and have been riding smaller bikes for 2 years now the r6 i am looking at costs 6000 with very low miles and an aftermarket exhaust from a dealer and i will be making a 2200 trade in which will go towards the bike but the rest will have to be financed. i heard the online quote is wrong because i didn't use my social security number and is different from the real quote i should get. also the loan will most likely be under my parents name and if u know of what type of coverage i will need since it is financed ive been doing alot of studying but thought id ask on here. i live in wisconsin which isn't a very populated area which should also make a difference if u know anything or need to know anymore just ask thanks alot

Term Life Insurance Ownership?

My wife and I are in our 40's and 50's. We have created A/B trusts and transferred our assets to them, and expect to have estates that will benefit from the estate tax saving these trusts afford. We recently both purchased $1M 10-year renewable term life insurance policies that we expect to keep for 10 years. We chose not to use life insurance trusts because the purpose of the policies is to replace the lost income of the deceased spouse if one of us dies relatively soon, not to increase our final estate, and the trusts are somewhat costly. We each specified our own trusts as the beneficiaries, because we want the disposition of assets specified there to be used for this money. The trusts provide for the income, and principle if needed, to be paid to the spouse, and for the remainder to be paid to our child at the remaining spouses death. The question of ownership of the policies is less clear. My lawyer says that it doesn't make much difference who owns them, because the value (estate) taxed is only one year's premium, not the $1M. My accountant says that the $1M is taxed, and that each policy should be owned by the other spouse to avoid tax on that amount. A friend said that there's no way to avoid or significantly decrease the tax, so just leave the ownership as is (each spouse owns their own policy). A further fly in the ointment is that the insurance company (Massachusetts SBLI) makes some forms of trust ownership more difficult and costly. I'm confused. What ownership is the best? What is the benefit of that choice? Thanks for your time.
